We provide professional photography services, which may include but are not limited to:

  • Branding photography

  • Portrait sessions

  • Branding photography

  • School photography

  • Digital image delivery via online gallery

Specific services, pricing, deliverables, and timelines will be outlined in a separate written agreement or invoice.

3. Booking and Payment

  • A non-refundable retainer may be required to secure your session date.

  • Full payment terms will be outlined in your service agreement or invoice.

  • No date is reserved until the retainer and signed agreement are received.

  • Late payments may result in delayed delivery of images.

We reserve the right to cancel services for non-payment.

4. Cancellations and Rescheduling

Cancellation and rescheduling terms will be outlined in your signed photography agreement.

Retainers are generally non-refundable unless otherwise stated in writing.

We reserve the right to reschedule due to circumstances beyond our control, including but not limited to illness, emergencies, weather conditions, or equipment failure.

5. Image Delivery and Online Galleries

Images are delivered via a secure third-party online gallery system.

  • Gallery access may be time-limited.

  • It is the client’s responsibility to download and back up images before expiration.

  • We are not responsible for lost files after the gallery expiration date unless otherwise stated in your contract.

Image turnaround times will be communicated in your agreement.

6. Intellectual Property and Copyright

All photographs taken by Margaret Nissen Photography are protected by United States copyright law.

We retain full copyright ownership of all images.

Clients receive a limited, non-exclusive, non-transferable license for personal use unless otherwise agreed in writing.

Images may not be:

  • Sold

  • Edited or altered without permission

  • Used for commercial purposes

  • Submitted to contests or publications without written consent

Commercial usage requires a separate licensing agreement.

7. Portfolio and Promotional Use

Unless otherwise agreed in writing, we reserve the right to use images for:

  • Portfolio display

  • Website galleries

  • Social media

  • Advertising and marketing materials

If you prefer your images remain private, you must notify us in writing before your session.

8. Website Use

You agree not to:

  • Use this website for unlawful purposes

  • Attempt to gain unauthorized access to the website

  • Copy, reproduce, or distribute website content without permission

  • Interfere with website functionality

All website content, including images, logos, and text, is the property of Margaret Nissen Photography.

Any disputes arising under these Terms shall be resolved in the courts located in Napa County, California.
